This English version is provided for convenience. The French version of these terms (read in French) prevails in case of discrepancy, without prejudice to the mandatory rules of your country of residence that protect you as a consumer. Prices, currency and payment methods are those shown in this edition of the site at the time of order.
Service provider
- Léo Barcet (EI), sole trader (French entrepreneur individuel), public speaking coach
- Address: 157 rue de Belleville, 75019 Paris, France
- Email: contact@thepitchyouneed.com
- SIRET 843 365 594 00020 — APE 8559A — Formation continue d'adultes
1. Purpose and scope
These terms and conditions of sale (T&Cs) govern the public speaking coaching services sold by Léo Barcet (the “provider”) on the sites lepitchquilvousfaut.fr and thepitchyouneed.com and following the diagnostic call, in every edition of the sites.
They apply to consumer clients (individuals acting for purposes outside their trade or profession) and to business clients. Provisions reserved for one category say so expressly. They are provided to the client before any order; placing an order means accepting the T&Cs in force on that date.
Professional training: when a service is followed as vocational training (in particular when funded by an employer or another funding body), a training agreement is signed in addition. When an individual pays for it personally as a training course, a training contract complying with Articles L6353-3 to L6353-7 of the French Labour Code is signed. In case of conflict, these documents prevail over these T&Cs.
2. Description of services
The services offered are:
- Essentials — $150: 1 session, 60 min. A diagnostic of your current pitch; A first structure, tailored to you; Your 3 priorities, in writing; Advice you can apply right away; Credited toward The Pitch if you continue within 30 days.
- The Pitch — $950: 5 h of coaching + your script. Everything in Essentials; Your script, written for you (2 to 5 min); Two rounds of script revisions; The full S.C.E.N.E. method; Personalized exercises between sessions; Recordings of your sessions; 15 days of follow-up.
- The Speaker — $2,900: 10 h of coaching + 3 months of follow-up. 10 h of one-to-one coaching; A keynote or speech written for you (up to 45 min); Your signature writing style; In-depth work on posture, voice and gesture; A 30-min check-in every week for 3 months; Preparation and debrief of your talks.
All sessions take place online, by video call.
The provider has an obligation of means: he applies his expertise to help the client progress, but cannot guarantee an outcome that also depends on the client and on third parties (investors, juries, customers).
3. Prices and payment
3.1 Prices
The applicable prices are those shown on the site and in the written proposal at the time of order:
- Essentials — $150
- The Pitch — $950
- The Speaker — $2,900
Prices are in US dollars (USD). The price shown is the total price to pay, with no additional fees. The provider may change his prices at any time; new prices only apply to orders placed after they are published.
The price of Essentials ($150) is deducted from the price of The Pitch if the latter is ordered within 30 days of the session.
3.2 Payment methods
Payment is made on order by:
- Credit card via PayPal
- Bank transfer (upon request)
No session is delivered before payment.
3.3 Business clients
Invoices are payable on receipt, with no discount for early payment. Any late payment automatically incurs late-payment interest at three times the French statutory interest rate, plus a fixed recovery fee of €40 (Articles L441-10 and D441-5 of the French Commercial Code).
4. Order and confirmation
Orders are placed as follows:
- A free, no-commitment diagnostic call helps choose the right offer.
- The provider emails a written proposal: offer, price, payment terms, provisional schedule, link to these T&Cs and withdrawal form.
- The client accepts the proposal in writing (by replying to the email), then pays.
- The provider confirms the order by email (durable medium), with the applicable T&Cs, and schedules the first session.
The contract is concluded when the client's written acceptance is received. Payment (or the first instalment) is due on order and is required before sessions take place.
5. Right of withdrawal (consumers)
Consumer clients have 14 days from the conclusion of the contract to withdraw, without giving any reason and without penalty (Articles L221-18 et seq. of the French Consumer Code).
How to withdraw
The client informs the provider of their decision before the period expires, by a clear statement emailed to contact@thepitchyouneed.com, or using the model form in the appendix. The provider acknowledges receipt by email.
Refund
The provider refunds all amounts paid no later than 14 days after being informed of the withdrawal, using the same payment method as the client, unless the client expressly agrees otherwise, and at no cost to the client.
Sessions before the period ends
No session takes place during the withdrawal period unless the client expressly requests it in writing. In that case, if the client then withdraws, they pay an amount proportionate to the sessions already delivered (price of the offer divided by the number of hours planned), and the rest is refunded.
The right of withdrawal no longer applies once the service has been fully performed before the period ends, at the client's prior express request, with the client's written acknowledgement that they thereby lose their right of withdrawal (Article L221-28, 1° of the French Consumer Code). This is the case, for example, of Essentials held at the client's request within the 14 days.
6. Performance of services
6.1 Timing and format
The first session takes place within 30 days of the conclusion of the contract, subject to the withdrawal period; the following sessions follow the schedule agreed with the client. Sessions take place by video call.
6.2 Technical requirements
For online sessions, the client needs:
- a stable internet connection;
- a working webcam and microphone;
- a quiet environment;
- a computer or tablet with a recent browser.
6.3 Client commitments
The client agrees to:
- attend scheduled sessions on time;
- give at least 24 hours' notice to reschedule;
- take an active part in the exercises;
- keep the methods and materials provided confidential.
6.4 Session recordings
Sessions are recorded only with the client's explicit consent, for coaching follow-up. Recordings are confidential and deleted no later than 6 months after the end of the programme.
7. Rescheduling and cancellation
7.1 Rescheduling
The client may reschedule a session free of charge with at least 24 hours' notice, with no limit.
7.2 Late cancellation
For cancellations less than 24 hours before a session, the client has 3 “jokers” per programme: the session is rescheduled free of charge. Beyond that, a fee of $120 applies to cover the reserved slot, except in case of force majeure or a documented health reason.
7.3 Provider unavailability
If the provider is unavailable, the session is rescheduled to a date agreed with the client, or fully refunded if no new date suits the client.
8. Commercial “satisfied or refunded” guarantee
In addition to, and without limiting, the client's statutory rights, the provider grants a 30-day satisfied or refunded guarantee on every offer and in every edition of the site. If the client is not satisfied with the results, they may request a full refund within 30 days of the end of the programme, through a reasoned request.
Reasoned request
The request is sent in writing to contact@thepitchyouneed.com. It is reasoned when it states:
- the goal agreed at the start of the programme, during the diagnostic call or the first session;
- how the result falls short of that goal, with concrete evidence: the talk delivered, the feedback received, the session videos.
The result is judged on the talk itself (structure, clarity, ease), not on a third party's decision: an investor, a jury or a customer. A request that only expresses dissatisfaction, without this evidence, is not a reasoned request.
Conditions: the guarantee applies if the client has completed the whole programme: all planned sessions took place (rescheduling remains possible, see Article 7) and the exercises assigned between sessions were done.
Process: the provider answers the request in writing. If it is accepted, the refund is made within 14 days, using the payment method used for the order.
Revisions and follow-up
The number of coaching hours, revision rounds and the length of follow-up are specific to each offer and described in Article 2. The guarantee does not entitle the client to any session, revision or follow-up period beyond what the chosen offer includes.
9. Intellectual property
The methods, exercises and teaching materials provided remain the property of Léo Barcet. The client may use them for their own personal and professional purposes, but may not reproduce, distribute, sell or pass them on to third parties without permission.
Texts written for the client during the service (script, pitch, speech, outline) belong to the client once the service is paid for: they may use and modify them freely.
10. Confidentiality
The provider undertakes not to disclose any personal, professional, financial or business information entrusted by the client during the service: projects, ideas, figures, difficulties discussed. This commitment continues after the service ends.
11. Liability
The provider performs his services professionally, under an obligation of means. He cannot be held liable for the outcome of a fundraising round, a competition or any decision made by a third party.
Consumers: these T&Cs do not limit the consumer's right to compensation if the provider fails to meet his obligations.
Business clients: the provider's liability is limited to the price paid for the service concerned, except in case of gross negligence or wilful misconduct.
12. Force majeure
Neither party is liable for a delay or failure caused by force majeure within the meaning of Article 1218 of the French Civil Code (natural disaster, pandemic, major network outage, for example). Affected sessions are rescheduled; if the impediment lasts more than 3 months, either party may terminate the contract, and sessions not delivered are refunded.
13. Personal data
Léo Barcet, as data controller, processes the client's data (identity, contact details, exchanges, information shared during sessions) to perform the contract, and billing data to meet his accounting obligations.
Retention: service-related data is kept for 2 years after the last interaction with the client; accounting records for 10 years, as required by law; session recordings for no more than 6 months after the end of the programme.
Data may be processed by the site's technical providers (hosting, email, analysis of messages sent through the site assistant, booking, payment), some of which are established outside the European Union. Data is never sold.
The client can ask for access to, correction or deletion of their data by writing to contact@thepitchyouneed.com. Details of the data collected on the site are given in the legal notice.
14. Complaints and mediation
Any complaint is sent in writing to contact@thepitchyouneed.com. The provider answers as quickly as possible and seeks an amicable solution.
Failing agreement, and after this written complaint, consumer clients may refer the dispute free of charge to the consumer mediator the provider belongs to: Médiation de la Consommation & Patrimoine (MCP), 12 square Desnouettes, 75015 Paris (mcpmediation.org).
Consumers living in another European Union country may also contact the European Consumer Centre of their country (ECC-Net).
15. Governing law and jurisdiction
These T&Cs are governed by French law. For consumers, this choice does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.
Consumers may bring proceedings, at their choice, before the courts of the place where they lived when the contract was concluded or any court with jurisdiction under the law. Between businesses, and insofar as the law allows, the courts of Paris have jurisdiction.
Clients outside France: online sessions are deemed performed in France, where the provider is established. Where the law of the client's country imposes more protective rules, they apply in addition to these T&Cs.
16. Language and changes
These T&Cs are written in French and translated into English for the English-language editions of the site. The provider may change them at any time; the applicable T&Cs are those in force on the date of the order.
